Does 240.21(B)-feeder tap Apply?

Does 240.21(B) feeder tap apply? if not what code apply? Thanks

If I'm understanding your diagram correctly, there is no OCPD between the point labeled POI and the grid. So then the blue conductors at the POI are service conductors or a line-side connection. For 2020 NEC and the latter treatment, 705.11 and 250.25 apply.

I agree. These are not 240.21 tap conductors. 705.11 rules.
I would question, however, if that connection to the bus can be made without an NRTL field evaluation.
