Does 300.3 cover a service convience outlet.

Hello fellow code nuts,
I have a service convience outlet placed or bolted to a disconnect. 3 phase 120/208. I do not personally like this installation. but I can not find a code probition against it ... the outlet wires are run with the feeders to this disconnect and pass part way through the disconnect and to a weather proof enclosure.

as I stated before I do NOT like this installation but, what can I do about it? I want to run a new EMT for it and it DOES feed from the same panel as the disconnect.

See it all the time. I don't have a problem with it.

Very common in this area and I've heard of no associated problems.
I guess it is possible in some situations to encounter a derating issue cause by the additional conductors.
