Duct and switch

Something must not be right here, though I am not sure how to reference it. Any code guidelines?

I cannot think of an NEC off the top of my head, but besides the crushed duct, I do not see a proper heat sleeve for that wall penetration.

However, IMC 2009

603.11 Furnace connections.

Ducts connecting to a furnace shall have a clearance to combustibles in accordance with the furnace manufacturer?s installation instructions.

Is the electric box cut into a wall? Or is it into a duct plenum?

I think the duct turns down into the wall to service a room on the next lower level (though I could not completely verify this). It did not appear that the switch is within a plenum.

I was thinking exhaust duct, supply and return air probably does not need a heat sleeve.
