EC&M 440.8 tubs and showers

The Jan issue of ECM has a Code Basics article about AC and Fridge equipment. It notes that (NEC 440.8) AC equipment cannot be within eight feet of a tub. Which would preclude AC equipment in an attic directly above a tub or shower. I suppose that would preclude a bathroom and furnace closet sharing the same wall?
 
Was this the author of the article's opinion that said attic unit would be a code violation?

That's pushing things pretty hard if there is a barrier effectively making them in separate rooms/spaces. If there is a door or other opening that leaves possible hole to exploit with opinions on this.

The author cited 440.8
 
The inside portion of a mini split kind of makes sense to be what was the primary thing that prompted adding this to the code.

Anything located in an attic above the space should not need to be considered in violation of this rule unless perhaps it has access through the ceiling over the mentioned spaces. The 8 foot limitation would still be a factor should the ceiling be high enough.
