eGauge Energy Metering - Class 1 Circuit?

We've used these for years and have always been allowed to run the CT's with fused power conductors as they've been considered a class 1 power limited circuit - 725.48(B)(1). The CT's measure current only, they're not for control or signaling. I now have an inspector that says no, it's a class 2 circuit and therefore the CT's can't be run with fused power conductors. I'm trying to gather as much info as I can for my rebuttal. Any thoughts?

The data sheet does not say if class 1 or 2. It is UL listed.
Perhaps a call to the mfg or UL.
To me it appears to be Class 2, if so look at some separation in the raceway, perhaps 3/8" flexible metallic conduit.
 
It does indicate that the wire is 18ga 600V rated. I guess it all depends on how and where you install the CTs. For what reason do you have to run the CT leads with the power? I would think you could have them exit the enclosure ASAP and continue to the monitor device as any CL2 wiring. Much easier.

I don't see anything that states the device is CL2 Rated. Since it's not CL2 rated, CL2 cabling can not be used. since you can't use cl2 cabling it's not a CL2 circuit. That probably why the manufacture uses UL1015 wire. How ever if you are putting the Manufacture cabling (UL1015) in to the conduit then the inspector is correct for the wrong reason. UL1015 is AMW hook up wire and when not used as a CL2 ckt, it can not extend beyond the enclosure it originates from. You would need to add some terminals and extend with MTW, THHN ect.

My favorite CL2 story was in 1991 the cabling I specified got rejected at final inspection due to not having a smoke rating. after 4 week of negotiating with the inspector and Belden. Belden agreed to officially rate the cable as 10, the worst posable rating available. The inspector was happy with that he only needed a rating did not mater what it was. in 45years never had any other inspector ask for that.
 
My assumption (never good) is whenever a device isn't labeled as class 2 or 3 it's treated as class 1. If I already have a raceway that I can use obviously that's a lot easier than running a new one.
