Electrical disconnect for gas tankless water heater

Yes a disconnecting means is required. How is it wired? A cord and plug would qualify as a disconnecting means but not likely if it's outdoors.

Why is a builder telling the electrcian how to do their job? Does your state have no licensing? Does the builder know the NEC better than the electrician?
 
It's basically the code enforcement not enforcing the code ,,i had a call with the code guy and cite the code to him and his response is they don't enfore that particular code . OK as a HI I am putting it in my report yall go figure it out , Gezz

It's required so call it out as a defect and let them sort it out. The fact that they "don't enforce that particular code" is not for you to decide.
 
The unit can only be connected by a cord outside if the unit came with the cord installed from the factory. It must be listed as a "cord connected appliance" and the code lists the maximum length of the cord. If its not on that list and did not have a factory cord on it, it needs to be hardwired.
 
There must either be a disconnect within sight or the disconnect must be lockable. This is to reduce the likelihood of someone turning the breaker on while you have your hands in the equipment, you can see them and yell at them and yank your hands out before they shock you, lol.

NEC 422.31(A) or (B), depending on the size. Same in IRC Table 4101.5.
