In our retail projects we like to place our tenant panels at the rear of the space. The architect shows the bathroom door on the floor plan as open and it appears that our panel doesn't have the 3 feet clearance. Is it a volation to place the panel there? My thinking is the door is not a permanet structure, so clearence is gained when the door is closed. I have not seen anything in the NEC that gives me a clue. Can some help me with this delima? Site any applicable codes that may apply.

It's a common question, and its answer often lies in the hands of the local authority. My answer is that if a panel has clearance with the door closed, then you have satisfied the NEC requirements.

110.26 (B), and tell the architect he needs to supply a door with an automatic closing mechanism. This way the door can't be consistently left open, thereby blocking access or view of the panel.

But then, the store clerks will stack a bunch of junk in front of it anyway.
