Does the NEC state / recommend that electrical products sold into the US market must carry a safety approval mark e.g. UL, CSA etc.

Yes, nearly every device, material, and equipment must be listed by an aprroved agency. For the 2002 NEC, the code even provides a list of product safety standards in ANNEX A.

However, the code doesnt state or recommend what can be SOLD, just what is allowed to be USED or INSTALLED. Unlisted products are readily available :)

There is no NEC requirement that all equipment be listed, it has to be approved by the AHJ, see section 90.4. Listing is one of the methods that an AHJ may use to determine suitability. See the definitions of listed, labeled, approved and identified.

My experience is that most inspectors (not just electrical) will generally not approve the installation without some kind of listing/labeling, this keeps their butts from the fire.
I have run across this the most with 'custom' lighting.
