If you have downlight fixtures daisy chained with 12/2 mc cable and some of them have EM packs can you just splice the 12/2 feeding the normal fixture with 12/3 to run to the fixture with the EM pack? The EM pack fixture needs a constant hot for the battery but I’m concerned the hot wire that Im thinking about could be a switched hot and would not work. Is my thinking correct?

You are correct. If you have a constant hot at the switch, then you would need to daisy chain with 12-3 from the switch. The constant hots would simply pass through your normal fixtures so you have an unswitched "hot" conductor at your EM fixtures for battery charging.
