EM stop for public spas

I came across an issue where a resort and it's upper management have removed the emergency stop stations on 5 different in ground spas - when I asked why.. one of the managers says its due to the fact that all the spas are gravity fed from a collection tank plus referencing the Virginia Baker Act (when all spas had to install vortex drains and more than one) I get that about the entrapment issue and caused a fatality.. maybe more than one.
But then why is there no exceptions to code section 680.41? only an interpretation like found in the NEC handbook - that is not an exception - so if 680.41 states in Black and white that the e-stop must exists - how are they then allowed to simply delete them? Do they need authority to do so and if so, from the electrical AHJ ? Or can a company simply do what they want ?
