Emergency article 700 feeders and branch circuits

I recently did a walk through in a building with a emergency generator. I noticed in the electrical rooms on each floor it was wrapped with wire ways.
The emergency feeders and branch circuits occupied the same wire ways as normal power.

I see this as a violation since a wire way is considered a raceway.

I was told since it's in an electrical room it's ok.

My question is. Emergency feeders and branch circuits in same wire ways with normal power a violation.

It is a violation. I see no exceptions. Physical barrier required, I have had to run a piece of flex from the incoming to the outgoing emergency conduit in a wireway before. And yes I know there are listing problems and possibly # of bends problems with this. The lesser of two evils.
