Emergency POE lighting

I have office space project with POE lighting in NYC, client wants to use some of 12 Watts POE lighting fixtures as emergency lighting.
POE vendor suggested using LED battery pack, see specification in link below.
According to my understanding CAT5/CAT6 cable between battery pack and lighting fixture must comply with article 700.

My questions:
1. Is it permitted to use CAT5 or CAT6 as emergency wiring in this case?
2. Should CAT5 or CAT6 be installed in conduit or just have to be supported independently from normal CAT5/CAT6 wiring?

The power source would have to be listed to UL 924 and wiring between the power source and the lights would be required to comply with the rules in Article 700. I did not see a rule in 700 that said the use of CAT cable is prohibited.
 
Several days ago I asked Lutron representative about his insight of POE lighting and what Lutron has to offer. He sent me list of 10 disadvantages of POE system. Two of them listed below.

1. The NYC advisory board had determined that an electrician is required to run POE wire. This eliminates the labor savings advantage. (My note: this could be correct in order to comply with article 700)
2. How is Emergency handled? The NYC advisory board has determined that line voltage is required for Emergency fixtures, not POE.

Later I told him: I cannot find NYC ruling that states the emergency lighting fixture is required to be line voltage and electrician must wire POE. Also I asked him if he has official ruling/bulletin/document issues by NYC advisory board. He told me “these ruling have been vague and not officially announced, but other engineers that sit on the NYC advisory committee have mentioned this ruling”.

At this point I don’t see reason to reject an installation of POE lighting and CA5/CAT6 for emergency system as long as: power source is listed to UL 924 and wiring comply with article 700.

Submitted battery pack is listed UL 924.
