Emergency Power System for high rise

I'm doing a complete refurb of the 17thfloor of an 18th story building. The existing EPSS consist of a diesel on the ground level and unrated feeders throughout the building.

I'm on record as requireing a 2 hour rated (Mass requires 2 hours) from a new emergency closet on the 17th floor down to the generator distribution panel.

By the way, the nearest source if I don't go to the ground floor is the 10th floor where there is a 30 year old panel with no 3 pole spaces and again fed via unrated cable. My contention is that given the fact that this is a complete renovation of an entire floor they ought to update their emergency system to accomodate it.

This needless to say has not gone over well. Latest question I've gotten is - based on one of the contractors recent experiences - can we do the emergency system on this one floor with battery packs and photoluminesence exit signs.

Bearing in mind that I'm in letter of the code mode here, I'm trying to build my argument against doing this.

The best I can do is that a High Rise requires an Emergency Power System complying with the Mass Electrical Code. Clearly the 17th floor would not be connected to "a system".

a) Do you agree with this reasoning and b) are there any additional points I can site?
