Emergency power, Who decides?

School district would be my guess in that instance. I don't know that NEC requires it anywhere, they just describe how legally required vs. optional standby systems are to be installed.
 
Read Article 700.

I have never put a required emergency system (Generator) in a school.
But there might be a State or local code that requires it.

To be more precise, read the first sentence of the second paragraph of 700.1. The determination of what is, and what is not "emergency" lies with governmental agencies. If you need to know which of these agencies in your area have already determined which (if any) loads at this type of school would require emergency power, you would have to find a way to ask them.
 
Thanks guys for your help, I found out the emergency generator was a requirement from the owner and not a code requirement.

Then this would fall under Article 702 Optional Standby Systems.

Chris I agree that may be true but IMO we do not have enough information to make that determination.

If the building required emergency lighting (and I think that is a real possibility) and the owner decided that instead of battery units the owner wanted a generator that would leave it in Article 700 even though that actual choice to use a generator was an option not a requirement.

You are correct,

I had assumed (My bad:0) that the option of installing a back-up generator was made by the owner and there was not a requirement from the AHJ for emergency power. I didn't see the part about a school.

If the state has a governing body for school construction they would stipulate the installation of emergency power whether it is generator or standard e-lights
