EMT as EGC

Little help needed:

I have a FACP cabinet being fed by a 15 amp, 120 volt single phase circuit. The raceway protecting the conductors is EMT, it terminates at the FACP cabinet and at the panel by use of die cast, set screw connectors which are installed tight and set screws tightened. The circuit conductors consist of 1-ungrounded conductor(circuit 17), 1-grounded conductor, and 1-equipment grounding conductor. The EGC is terminated at the "earth" terminal on the solid state board within the FACP but does not extend to ground stud in FACP cabinet. Is this a violation of the NEC per 250-110 or is this acceptable per 250-118 (4)? Not referring to manufacturer requirements, strictly NEC requirements.
 
The Emt is suitable as a ground for the panel however if an equipment grounding conductor was called for in the plan then I suspect that conductor must ground the enclosure as well.
 
I agree, per specs, per manufacturer instructions or if called out on print by engineer then yes it should be installed to ground stud. But do you agree it is not a violation of the NEC per 250-118?

Take a look at 250.148-- I think if an equipment grounding conductor is run then it must be connected to the box
