I'm trying to determine EMT % fill for Ci Fire Alarm cable. Can someone tell me where in the NEC it lists the max % fill? I thought is was 40%

Typically type of cable does not affect the % of fill. The number/size of cross section of conductors does.
typically:
40 per cent for over 2 conductors, 31 per cent for only two conductors, and 53 percent for one conductor

Go to chapter 9 Table 4. Not sure if fire alarm cable is affected by this table.
