Enclosed or not?

I came across an outdoor diesel genset (500kW 208v) factory installed in an outdoor weatherproof enclosure. Both the genset and the enclosure sit on top of a belly tank. The genset has a local circuit breaker installed inside a factory electrical enclosure. The breaker handle is accessed through a door of the weatherproof enclosure. The bottom panel of the circuit breaker was removed and the load wires exit from the circuit breaker terminals unprotected to the preinstalled underground conduit system within the outline of the tank. With the doors closed there are no wires visible. The EGC is continuous and the conduits are bonded.

Do these wires need to be installed in conduit or does the weatherproof enclosure provide sufficient protection for the wires? Code references please.
 
So essentially, they are using the WP enclosure as a large junction box. I'm curious if the underground conduits are steel and whether they are bonded or not, since they are not ran complete to the bottom of the breaker enclosure?

445.14 is where I'd start.
 
Have you read the Art. 100 def of enclosure? Heck, a fence is an enclosure.

Thanks for this one. We do a lot of spas where we run PVC into the spa and then convert to carflex. Article 100 may just let me run the THWN alone. I would have to find a suitable connector for where it goes into the control panel though.
 
Hmmm.... in my OP the enclosure was modified by removal of the bottom panel. I wonder if this voids its UL listing and thereby making its a failed installation.
