ENT under sink

Would you consider small sections of ENT under a sink to be subject to physical damage? I have been using it to install the receptacles for DW/disp on the side wall of the sink cabinet for years but just realized 362.12 does not permit ENT where subject to physical damage. Here I thought I was doing a good job.

Under a resi sink, not subject to physical damage IMO. Perfectly legal.
