Equipment disconnect working space

Does the working space requirements of 110.26 apply to equipment non-fused disconnects that are fed from a remote breaker such as an A/C condensing unit? Can the equipment sit in front of the disconnect? I have argued the disconnect doesn't need to be serviced while energized but wondered what others think our have experienced.
