there is about 4" to the roof of this MCC.. is there a violation?

If it doesn't involve the electrical panel nothing foreign to the sustwm can be above the gear for 6' except the roof, not a drop ceiling. 110.26

If you are saying that the drop ceiling is a violation, I disagree. 110.26(E)(1) has an exception.

Exception: Suspended ceilings with removable panels shall
be permitted within the 1.8-m (6-ft) zone

The intent of the section about foreign equipment, is primarily plumbing and HVAC equipment, like piping and ductwork. Not structures and the drop ceiling itself.
 
(3) Height of Working Space. The work space shall be
clear and extend from the grade, floor, or platform to a height
of 2.0 m (61⁄2 ft) or the height of the equipment, whichever is
greater.

I don't see a violation if the ceiling is 6.5 ft or higher off the floor.
