I'm installing a wall ev charger in my garage do I need to install a disconnect as well?

If it is cord and plug then you don't need a disconnect .

Over 60 amps then the disconnect must be in site of

It's hardwired at 40 amp breaker 16amp draw

It does not appear to require a disconnect for under 60 amps. I have not installed a direct wired one but I assumed a disconnect was required

625.42 Disconnecting Means. For electric vehicle supply
equipment rated more than 60 amperes or more than 150 volts
to ground, the disconnecting means shall be provided and installed
in a readily accessible location. The disconnecting
means shall be lockable open in accordance with 110.25.
