I have EV chagring station. Manufacturer install instruction call for 40A breaker with #6 awg phase/neutral conductor size. The engimeer provided that however he provided #10 awg ground. Would not #10 awg gnd then needs to be upsize to #8awg ground? NEC 2017 Article 250.122(B)
 
With a strict interpretation of it, then yes.

Their upsize in wire could be for voltage drop or just because they had it in the truck. The NEC doesn't care. If they increased the wire size, they need to increase the EGC as well.

If you can tell from the plans that it was because of voltage drop then absolutely yes. You might be able to tell if the branch circuit is quite long.
