Existing Pool Sub Panel

I need to refeed an existing pool light transformer. I noticed the subpanel is feed with 10/3 or 12/3 romex it feeds 230v pool pump and light. This was installed 20 years ago or more. Is Romex feeding a pool subpanel legal. According to 680.25 A Exception. An existing feeder between remote panelboard and service equipment shall be permitted to be run in an approved cable assembly that includes an equipment grounding conductor within its outer sheath is. So I wounld think a bare grounding conductor is ok and does not need to be insulated. Am I right

Thank you, I was looking in the 2008 I will look at the 2011. I went back as far as 1984 handbook and it has the Exception saying an approved cable assembly with an insulated or covered equipment grounding conductor. I think covered was changed over the years to outer sheath. I spoke to one inspector so far and he thought it was ok he was reading out of the 2008 also. What do you guys think?
 
IMO, that was an acceptable situation at one time however the question begs to be asked if the panel was existing when the pool equipment was wired
