Existing sub panel wired correctly (ground issue)?

I am adding a circuit to an existing sub panel in my garage for a pool pump. I understand the code for the pool, what I have a question on is if the existing sub panel is wired correctly.

These is a 50 amp double pole breaker in the main panel inside the house feeding the circuit. There are 3 number 6 wires in pvc conduit ran underground 50 feet to a detached garage. The garage does not share any common utilities like water or gas. The sub panel has the neutral and ground separated. There is a ground rod out side the garage that is connected to the ground bus bar. There was no grounding conductor pulled in the pvc conduit.

I have read many post on the forum and can not decided if this setup is legal and safe. If it is not what can I do to correct it before I start the wiring for the pool.
