Exposed Live Elements In Dead Front Panel

Hello all,

A contractor installed some relay modules in a dead front panel, but when they reattached the cover, some of the live elements on the relays are exposed. The following pictures shows the situation.

These live elements are not exposed when the door to the panel is closed. I know the panel loses it's dead front listing with these live parts exposed, but does anyone have any experience with these kind of installations? Is there any exception to NEC 408.38? Any further information (code violations or exceptions) would be greatly appreciated. Thank you!
 
It appears to be commercial, possibly bolt on panel that has a screw on dead front that covers the breakers.
Around the outside is an air gap that when the actual cover goes on is covered.

What is a 'dead front rating' and where is it required?

The cover is not open, the cover is off. When the cover is installed there will be no live parts exposed even with the cover door open.
 
The cover is off and the OP's probably calling the cover that's over the breakers the "Dead Front" like most of us do, and, is concerned that the load side terminals of the breakers are showing despite the Dead front being in place.

I think he is referring to 408.38 - enclosures that are not a dead front can only be accessible to qualified personnel.

I agree, that's what the picture looks like, but he said something different. I'm thinking that the electrician has somehow managed to make the live parts exposed when the cover is on and the door is open.
 
It could be a hinged panel cover, in which case it could be considered "open".

it doesn't look like it.... it looks like it's been around a while,
and the screw holes on the dead front look like they are
used to hold the cover on.

i'm guessing here, but those terminals look like they are as
far back in the can as the breaker terminals, and only visible
when the cover is removed with a screwdriver.

I agree , and looks like it's in a school, flush mounted in a block wall, probably in the gym but I'm speculating.
