Feeder for two panels?

I have (2) 100amp-rated control panels that will be fed from a single 100amp/240 volt feeder circuit. (Each control panel has an integral panelboard for branch circuit wiring for equipment connections). The panels are installed side-by-side and interconnected by a gutter below. Usually, one panel is fed from the other via a breaker, but on this application I would prefer to splice the feeder in the gutter and run to each panel above. Is there any Code issues that would prohibit this installation?

The total load won't exceed 75 amps, and the OCPD will be just the one 100amp breaker.

Any input would be helpful.

Thanks
Greg

Greg, if I understand the set-up correctly, I would see no NEC problem with what you describe as long as applicable rules are followed (wire fill, bending radius, etc).
In our juridiction (TN) the asssembled "control panel" would need to bear a UL or other NRTL label and any internal wiring would be covered by that third party certification.
