Feeder or Secondary Tap ??????

An Exisitng installation consists of a MDP with the main switch fused at 2000A 480V, 3 pole. There is an exisitng panelboard that is fed from taps on the bus bar in the MDP (NOTE: NO switch). Is this installation considered a feeder or secondary tap ???????????
 
feeds a 400A, main breaker panel board 24 ft away. The conductors are run in 12 ft. of cable tray with the remainer run to the panel, in 3" IMC.

Yes, the conductors are tap conductors.

If the conductors have an ampacity less than 1/3 the Main OCPD (2000A ? 1/3 = 667A), the installation would be in violation by current code. However, since this is an existing installation, compliance is determined by the code cycle under which it was installed, which may differ substantially enough from current code to make it compliant as is.
