Feeder tap??

A friend of mine found that somebody tapped onto old feeders protected by a 100A breaker with #6 awg, ran the #6 through the attic and out to a 60A breaker feeding an AC unit. The 100A feeder breaker is in the picture attached. My breaker guy said they only made one breaker for this panel and it's the 100A that's in place- that I could possibly modify some sort of feed through 60A breaker to fit possibly.

I told my friend that since there is a 60A breaker near the AC unit that it is protecting the #6 upstream from it and its probably safe to leave the 100A breaker at the main. I Linda see it as a feeder tap in a way.

Thoughts on NEC compliance of what I explained?

The old 100A feeder tap conductors are only tapped to the #6 and do not feed anything else.
