That is a good question. I knew that it was not allowed and thought it might be specifically addressed in the Code, but I found nothing other than what Bob states. 310.4(B)(5) shows one provision for parallel conductors as "terminated in the same manner".
 
Parallel conductors must have all the same characteristics. By tapping only one of the parallels they no longer have the same characteristics.

It's also anyone's guess how the current will divide.

We also do not know the loads which could lead to other violations.
 
310.4 Might be a good spot.
