Absolutely yes, unless local amendments (I'm talking to you, NYC) say otherwise. You may have to negotiate with the AHJ as to whether any portion of the cable run is "subject to mechanical damage" which would require a raceway, or the installation of plenum rated MC (if you need plenum rated).
