if the percentage of fill is 40% for fire alarm wiring on an existing system, is there anything in the code that says this percentage can increase for any new future wiring?
 
No. Many decades ago there were two percentages for wire fill in the code. There was a 25% fill for new work, and a 40% fill for re-work where additional conductors were added after the original installation.
Now there is just a 40% fill and that applies for both new and re-work.
