Fire damage dwelling unit

Get this their is fire damage in apartment complex dwelling unit. Bedroom was wiped out so they are replacing in kind branch circuit wiring to receptacles and lights along with receptacles and lights itself in bed room.

Now the panelboard branch circuit breaker does not have AFCI. The electrician is like we are not touching the panelboard only wiring we don’t need AFCI. Told the electrician NEC 2014 section 210.12(B) to replace the branch circuit breakers to receptacles and lights to be AFCI.

Electrician denied says it’s wrong.

Am I missing something or the electrician is right?

210.12(B) 2 exception: AFCI protection should not be required where the extension of the existing conductors is not more than 6 feet and does not include any additional outlets or devices.

If they are only adding less than six feet to the wiring and no new devices or outlets. Then they don’t have to, if they are wiring the hole premises then yes they need AFCI protection.

That circuit needs to be AFCI protected.

Unfortunately, just reread, I too was originally told by AHJ no AFCI required, but was later called and told by him he was wrong and it does need to be brought up to code, AFCI is required. Quoting 210.12(D) Branch Circuit Extension or Modification - Dwelling Units and Dormitory Units. In any of the areas specified in 210.12(A) of (B), where branch-circuit wiring is modified, replaced, or extended, the branch circuit shall be protected by one of the following:
(1) A listed combination-type AFCI located at the origin of branch circuit......
So it appears that if you replace damaged wire it needs AFCI protection. I too have to break it to the customer the job just jumped up by $1200.
