Fire pump line side wiring

I seen in article 695 NEC 2008 That EMT is not acceptable on the 'load' side of the fire pump controller. I do not see it forbiding it on the 'line side' of the controller. But is it legal to do that? why would it not be forbidden on the line side since that is the main power feed for the fire pump?

FWIW, EMT was added to the permitted wiring methods on the load side in the 2011 NEC.
 
You might discuss the point that Smart mentioned to your AHJ. Often, when an upcoming Code allows something not accepted in your current Code they will allow the revision.

EMT is not in and of itself prohibited for the supply to a fire pump but you must also consider the fire rating of the how the supply is routed to the fire pump room. In most cases that means running outside the building (same as would be required for service conductors) which could include the use of EMT.
