Have a location that is a detention facilty with a fire pump. Building has a stand-by gen-set and an ATS which supplies the building as well as the fire pump. Question: Is the fire pump supposed to have its own ATS??

Yes, and it has to be rated for fire pump service. It also needs to be in the fire pump room. The way this is normally done is with a combination fire pump controller/transfer switch as this is the most economical and easy way to do it.

I will assume by the way your question is worded that this is an existing installation. When I worked for the prison system we had a older correctional hospital ( more like a nursing home) anyway. It had a fire pump for a section of the building that had 3 floors. The AHJ deemed it was fine to have it on the optional stand by generator system because of the setting. Their reasoning was that the prison was manned 24/7, it was equipped with battery back up egress lighting and a monitored fire alarm system.
Point being there may be some reasoning by the AHJ to override the NEC.
