Fire rated floors

I?m part of a retro fit project that is a two story building. There is no construction on the second floor, only the first. First floor is being demo out and new walls are going up. Some of the new walls are now fire rated walls. Not all of the cabling was demo out because it is feeding the second floor. So we installed UL fire rated split sleeves where cables were going through the new fire walls. Now, here is the question: If there is a 7? gap between the exterior wall and second floor that goes round the whole building, does that make the second floor a ?non-rated? floor and what does that do to the ?fire rated? walls on the first floor?
 
This question is best asked of the local building department. The determination when, where, and how fire-rated walls are built and required come from the building codes.
