Is there a code requirement for this or is it building code or both? I am told that thru fire rated wall it must always be done.

I don't think it is an NEC issue (but what do I know) but every job I have ever done had specs for fire stopping for fire rated walls. If the project had an unusual situation we would have to get an engineering judgment with a drawing from the manufacturer, usually Hilti for the company I worked for.

If you breach the fire rating, you are responsible to return it back to the proper rating.

In case you don't know, you cannot install an old work box with madison clips in a fire rated wall. A box has to be supported by a framing member (attached to a stud) to maintain the UL listing of a fire rated wall.

Was not aware of that regarding the old work box.
