We installed a lighting track system that is suspended in an open area by aircraft cable approx 16? down from the upper structure.

The power feed is a SJ cable that drops from the ceiling to the live end of the track.

We feel that this is a proper installation under section 2008NEC 400.7A(9) that allows flexible cord for the connection of moving parts.

This type of installation is even sold by most manufacturers as a kit.

The AHJ is stating that because this is a permanent installation it has to be fed from MC not SJ cable.

We agree that the lighting track is not a luminaire

We do not think this is the intent of the code. Are we correct in this matter?

The city may have adopted a rule that supercedes the code. For example, in one city here houses are required to have all wiring in conduit, even though the code says NM is just fine.
The authority having jurisdiction wants what he wants. How many cords would you have to replace? Is it worth arguing with him, given that in the future he might scrutinize your work more closely?

The SJ cord may be part of a listed assembly from the fixture manufacturer.
It is very common on the decorative hanging track and pendent fixtures hanging by aircraft cable.

If it it listed by the fixture manufacturer and supplied as a kit from the same manufacturer, it should be accepted by the AHJ.

What tkb said plus 400.7(A)(2) allows flexible cord for wiring of luminaires. The track is part of a luminaire isn't it?
