Flush mounted receptacle in deck floor

What are the rules for deck floor receptacles (my take is that these are not allowed)? It does have GFCI protection. See photo

It does not look like a in-use cover.
And the gasketing in the photo may or may be approved for horizontal mounting with water exposure. I assume the deck is exposed to rain?
Probably not the concern of the NEC, but it looks like a tripping hazard too.

It is exposed to the weather.
 
You might want to take 314.27 into consideration:

[FONT=&quot]Boxes listed specifically for this application shall be used for receptacles located in the floor.[/FONT]
[FONT=&quot]Exception: Where the authority having jurisdiction judges them free from likely exposure to physical damage, moisture, and dirt, boxes located in elevated floors of show windows and similar locations shall be permitted to be other than those listed for floor applications. Receptacles and covers shall be listed as an assembly for this type of location[/FONT]
