No, it's just a cosmetic thing. The flush mount has a larger cover to hide the cut out in the wall.
True, but you could get dinged under the "not following manufacturer's instructions" catchall. :roll:
Is it unsafe? No.
But if the surface mount cover wraps around the edge if the can as some do it could make removal difficult depending on the building trim around it.
If you have a good working relationship with your wholesale house they may be willing to swap covers for you, which would be your best bet to avoid raising any flags in the inspector's face.:grin:

I would just mount flush with the edge of the wall and have the carpenter put some L beads around it.
