Fused and Non-fused wire in Same Enclosure

I have been searching for the code requirement, (2008) for combining fused and non-fused conductors in the same enclosure, no divider. This installation has a tap box from the utility, nipples to a wp gutter, with 4 100a meters out of the top of gutter. Contractor mounted the coresponding disconnects of each meter next to the panels, however he nippled into the gutter,not the meter. So now the non-fused from the utility feeds the meter, the load side from meter back into the gutter, enters the disconnect from the gutter, re-enters the gutter and exits as a feeder to the lease space from the back of the gutter. Confused? I am. Anybody have the chapter and verse? Thanks in advance.
 
Take a look at 230.7 if your enclosure quilifies as a raceway.
While it is commonplace to call these enclosures a "gutter", they seldom meet the definition. You can be assured if there is a nipple between it and equipment enclosures it is not an auxiliary gutter. As such, it is a wireway, which is a type of raceway.

From the OP's description I wasn't sure exactly what he meant so I tried to cover all, (well a few) of the bases. :)

Wow, sounds like a lot of in and out of the wireway, must be a big wireway to be compliant from a fill standpoint. As smart$ noted I also think this is a form of raceway and as such would not be compliant. IMHO it is bad practice in any event. I might also mention that many a POCO will not allow this.
