is there any code which requires fuses at commercial disconnects. I'm about to rebuild a disconnect for a restaurant and want to use a disconnect with a circuit breaker. I can't find a code addressing this issue

No NEC code requiring such - is this a local or local POCO thing to use fuses? If anything - that is if you are talking about main disconnecting means? - there may be AIC issues - in which case, series rating of the breakers used may become at issue...

As Mark pointed out the NEC does not require fuses however some utilization equipment specifies fuses of certain types and ratings.
