GENERATOR NEEDED ?

If a industry that needs a legally required generator on site for emergency power fails to maintain its gen in operational condition because of poor maintenance , are they subject to fines from the state should it not operate when needed and a inviormental haszard is created ? I beleive I no the answer but like to ask for all opinons if iI may .

Well, they are definitely in violation of 701.5, if their neglect would cause an environmental hazard I'm sure the EPA wouldn't hesitate to fine them.
 
It's often something looked at by the Fire Marshall in some jurisdictions I've worked in. I was on a job once doing something unrelated when the Fire Marshall came in unannounced one day for an inspection. Aside from the usual extension cord violations, he told the owner to demonstrate that their backup generator was functioning. It wasn't, which prompted an inspection of maintenance and test records, which were non-existent because of budget cuts. My original project was halted and I was given a new one to fix and upgrade the EG system, but the place was shuttered for 2 months during the process (long lead times). I felt sorry for all the other workers who had to go without pay.
