A commercial kitchen counter top ,3 feet from a sink.I know a gfci receptacle is required. but what if an appliance was to be hard wired instead of being plugged in . Would that circuit still have to be gfci protected. It seems the code only refers to a receptacle.

For 2014 some parts of the code refer to receptacles while other parts, including residential AFCI requirements and feeds for dishwashers refer only to outlets, either hard wired or receptacle.
What code cycle are you under?
As of [2011], for a commercial kitchen i believe that you are correct. But do not forget that the installation instructions for the appliance itself may call for GFCI protection.
