I have receptacle in dwelling unit Kitchen not on countertop but within six feet of sink.

I have person telling me it’s not on countertop of Kitchen so GFCI is not required NEC 2014 Section 210.8(A)

I said it’s within six feet of sink so GFCI is required regardless if it’s not on counter top


We are in NEC 2014.

Other person is correct or am I correct?
 
My inspectors have repeatedly required gfci protection on any receptacle within the 6 ft limits regardless of location on a countertop or not, even a refrigerator if inside that limit or a recepticle in a living room, dining area outside of "kitchen area" not seperated by a wall. So here I suggest you are correct. NEC 210.8(A)(7) within 6ft of sinks edge
210.8(A)(6) indicates regardless of proximity to a sink if it is to service a countertop it requires GFCI
 
This change rolled in the 2014 code:

2011: Sinks — located in areas other than kitchens where receptacles are installed within 1.8 m (6 ft) of the outside edge of the sinks.
2014: Sinks — where receptacles are installed within 1.8 m (6 ft) of the outside edge of the sink

Oddly, at least on NFPA link, the NFPA failed to mark this as a change.
 
Even where not required; a GFCI at 1st outlet can feed all downstream plugs, including those that go past required spaces into other rooms, if they get "GFCI Protected" stickers on their faceplates.

One of our veteran AHJ's and IAEI instructors explained to me, NFPA-70 is a permissive code. It allows for future expansion, and exceeding minimum requirements. It's called good design.

Since 2011: 406.4(D)(5) Replacement Code.
Most replacement plugs miss required Tamper Resistant (TR) devices in dwellings, much less AFCI protection in kitchens & laundry 406.4(D)(4) required since 2014.

When this crap is challenged in court, no insurance policy is required to pay for the casualty claim or burned down structures.
