Tim,

You are correct in that there is nothing to stop a service person from unplugging the sump pump and using the single (non-GFI) receptacle. Sometimes we have to look at the "intent" of the code and not the "practicality" of the code.

What if it were an active sump pump in a rain storm OR a sewer ejector pump ? I'm sure he wouldn't leave it unplugged for long ! At least not with some strong tell-tail signs that he's done something wrong.

By the way, I was told by one inspector that if you install a duplex receptacle on a non-finished basement wall it has to be GFI but if you install it on a ceiling rafter and plug the sump pump into it, it does not. Go figure that one out !!
