grandfathered code in MA

A liitle confused here, At my code update for 08 nec I was told that adding any outlet on existing circuits that the whole circuit had to be protected by a combo afci breaker, and new outlet added had to be tamper proof. I do work for an AV guy adding outlets for flatscreens etc, he says his other electrician said I am wrong, and so has an inspector saying that these were grandfathered in that they do not need afci protection or tamper proof receptacles. Can anyone provide me with articles on code or ammendments that I am missing. I have read a bunch of threads on arc faults and I am pretty sure I am right, but please correct me if I am wrong thanks.
 
the answer might vary by jurisdiction. My opinion would be any addition or alteration would have to be to current code, so if you added an outlet, I would say arc-fault and tamperproof. This as opposed to your replacing a defective outlet.
 
kinda kills me that the other electrical company says I'm wrong, and so doesnt the inspector that they asked. It makes me look like a fool and obviously there prices are going to be cheaper, so i think it is a no brainer who the av guy will hire. Any suggestions on how to approach something like this would be appreciated. Thanks again for the help.
 
I dont understand how any one can expect preexisting nonconforming wiring to now become your headache. It is not that way in NY according to state building code. New is new and old is old from what I understand here thanks to Pierrre.
