can you ground a panel that's 40 years old with no ground wire just a pipe ground from a new panel being installed 40 ft away by running a pipe over and tapping off the ground buss in the new panel

What do you mean by "ground it"?

you mean equipment ground or grounding electrode ground?

I think in this situation it is best to draw a picture and let the forum see what you have.

I don't see anywhere where I said "Ground it"
"Grounding" it would be to connect it to a grounding electrode, "bonding" it would be connecting it to a conductor that ensures it is at same potential as other conductive objects - in particular the "equipment grounding conductor".

As mentioned metal raceways in general are allowed to be used for that purpose.
