Hi-leg in a seperate pipe attached to a disconnect

I have a disconnect with a two pole configuration, and hi-leg entering the disconnect from a seperate conduit, passing through the disconnect and traveling into another pipe to a motor control using the power from the disconnect. All three wires travel in the same pipe to the motor control. I am not certain, but I believe this would fall under two powers in the same box without the same disconnect and I am suggesting a rewire placing the hi-leg in the same pipe with the other wires, and changing the disconnect to a three pole. Is this correct, or can I leave the hi-leg in the original pipe and just change the disconnect?

Thanx for the input. I am presently re-wiring a private school campus with dairy. Over the years they have had some pretty creative people, doing some pretty creative wiring and not always code proficient. After re reading 300, I am going with my first thoughts and rewire everything into the same pipe, and replace the disconnect with a three pole and then re-wire the motor control from the disconnect.
