Hot Tub Feeder

I just installed a Hot Tub that was delivered with an outdoor subpanel that contained a 2 pole 20 GFI breaker and a 2 pole 30 GFI breaker. These serve as overcurrent protection for the heater, pump and controls of the hot tub, as well as disconnecting means. I followed the directions and wiring diagram (for a change)supplied with the unit. It called for feeding the panel with a 50 Amp 2 pole breaker and #8 feeders. I installed it this way and the inspection is tomorrow. I'm thinking now that I should have used #6's. What are your thoughts and if the inspector has an issue, Do I have a defense?

You actually have 2 problems here. The ampacity of type NM cable is limited to the 60C column so #8cu is rated for 40 amps. 680.25 requires feeders to be installed in RMC, IMC, LFMC, or RNC. EMT is permitted on or within the building and ENT is permitted within the building. 680.42 permits other chapter 3 wiring methods if the spa or hot tub utilizes a factory installed or assembled control panel or panelboard. The connections described in 680.42 are from the panelboard you installed to the hot tub not the feed to this panelboard. If you installed a raceway between the new panel and its source #8cu conductors might be sufficient if all terminations are rated for 75C.

680.42(C) seems to permit NM as a wiring method as it say's:

any of the wiring methods recognized in Chapter 3 of this Code that contain a copper equipment grounding conductor that is insulated or enclosed within the outer sheath of the wiring method and not smaller than 12 AWG shall be permitted to be used for the connection to motor, heating, and control loads that are part of a self-contained spa or hot tub, or a packaged spa or hot tub equipment assembly.
And the fact that the title of the chapter is "680.42 outdoor Installation's"
And the heading of 680.42(C) is: "Interior Wiring to Outdoor Installations".

Also this was not changed for "2005"

Curt Using conduit from the new sub panel to the spa and fusing #8 at 50 is fine but the #8 nm would still have a 40 a ocpd.
