Hot tub GFI breaker and enclosure sizing

I'll be wiring a 30 amp 220V hot tub; outside set on a slab against the house. I'll be installing a 10-3 romex from a sub panel to a weatherproof disconnect located at least 5ft from the tub units water edge. I'm considering the 50 amp GFI and enclosure Home Depot carries as a set, instead of separately buying a DP 30 GFI and separate enclosure. is it permissible to fuse the tubs line at the sub panel @ 30 amp and install a 50 amp GFI @ the tub disconnect?

Dunno but keep in mind you cannot use UF from the disco to the tub. See 680.21, 680.25, and 680.42 (dont have my codebook in front of me, but the grounding wire must be insulated, and UF is not mentioned as one of the allowable wiring methods in one of those sections).

Art. 680A(4) Where a cable assembly is used, the circuit equipment grounding conductor can be uninsulated. Since UF is permitted inside a one family house, it will probably be allowed I'm not sure if a DP 50 GFI breaker acting as the tubs disconnect will properly ground fault a 30 amp circuit. I would think it would.

We had a thread here not long ago about using a 50A GFCI to provide groung fault protection for a smaller circuit. I don't see a problem in function or code, the GFCI will do its job and the 30A breaker will do its job. It is a little weird to do it that way.
 
As long as the wire at the panel is protected with 30 amps then there should be no issue with using a 50 amp gfci at the tub disconnect

That is fine, what JFletcher pointed out is on the load side of your disconnect.

The 50 amp breaker in the disconnecting means will be fine, you are not even required to provide GFCI or overcurrent protection at the local unit disconnecting means, a simple snap switch (of proper capacity rating) would be fine here as long as proper overcurrent and GFCI protection are somewhere "upstream". Most purchase these "spa disconnect" packages as that is usually the least expensive way to do it.

I'll probably go with the 50a GFI
outdoor disconnect w/liquidtite and thhn to the j-
tub J-box.
